This Privacy Policy (hereinafter referred to as the "Policy") establishes the principles and procedures for the processing and protection of personal data, based on which the Company, as a personal data controller, processes the personal data of data subjects.
1. General Provisions
1.1. PMC Baltic FZ-LLC (hereinafter referred to as the "Company") respects the right to privacy of all its customers (buyers), including visitors to the Company's website http://www.psichologijoscentras.eu/ (hereinafter referred to as the "Website") (hereinafter collectively referred to as "Customers") and commits to ensuring the protection of their personal data and their rights as data subjects.
1.2. This Privacy Policy governs the main principles and procedures for collecting, processing, and storing personal data of the Company’s customers (including Website visitors).
1.3. By using the Company's Website, ordering goods, and providing the Company with your personal data, you agree to the provisions of this Privacy Policy (except for data processing actions that will require your separate consent). Customers are considered to have familiarized themselves with the Privacy Policy when they check the "checkbox" below the text of this policy while registering on the Website/customer system. The Privacy Policy can be reviewed on the Website at any time.
1.4. When processing your personal data, we comply with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter referred to as the "Regulation"), the Law on the Legal Protection of Personal Data of the Republic of Lithuania (hereinafter referred to as the "LLPPD"), the Law on Electronic Communications of the Republic of Lithuania (hereinafter referred to as the "LEC"), and other directly applicable legal acts regulating personal data protection, as well as the instructions of the data protection supervisory authorities (in Lithuania - the State Data Protection Inspectorate).
2. Definitions
2.1. Personal Data – any information about a natural person whose identity is determined or can be determined (data subject); a natural person whose identity can be determined is a person whose identity can be directly or indirectly determined, primarily based on an identifier such as a name and surname, personal identification number, location data, and internet identifier or one or more physical, physiological, genetic, mental, economic, cultural, or social identity characteristics of that natural person.
2.2. Data Subject – a natural person who is a customer of the Company (including Website visitors) whose personal data is collected by the Company.
2.3. Data Subject's Consent – any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which they, by a statement or by a clear affirmative action, signify agreement to the processing of personal data relating to them.
2.4. Data Processing – any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, sorting, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
2.5. Data Processor – a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the Data Controller.
2.6. Data Controller – PMC Baltic FZ-LLC, address: Compass Building SFFO0507, Al Shohada Road, AL Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates, whose data is collected and stored in the Register of Legal Entities.
2.7. Cookie – a small piece of text information that is automatically created while browsing the Website and is stored on your computer or other terminal device.
2.8. Direct Marketing – activities aimed at offering services to individuals by mail, telephone, or other direct means and/or inquiring about their opinions regarding offered services.
3. What Personal Data Do We Collect?
3.1. The Company collects and processes the following personal data provided by you when registering and/or ordering services on the Website or by other means: name, surname, email address, phone number, data related to the provision of services, such as service and order details, invoice numbers, billing, payment details, information about consent and non-consent for processing personal data for direct marketing purposes, and any other data you voluntarily provide while registering and/or ordering, managing services.
3.2. The Company does not collect or store your passwords, credit card information, or other login details.
3.3. The personal data specified in point 3.1 is stored by the Company during your cooperation period (service provision period) and for 10 (ten) years after the end of this period.
3.4. The Company collects and processes the following personal data that you indirectly provide when registering and/or ordering services on the Website, i.e., these data are automatically collected from your used computers and/or mobile devices when you access the Website: IP addresses and login times, browser used and its version, websites visited before accessing our Website, data about service usage, e.g., data collected using cookies and similar technologies related to browsing the internet, etc.
3.5. The personal data specified in point 3.4 is stored by the Company during your cooperation period (service provision period) and, depending on the data, up to one year after the end of this period. These data may be stored for a longer period if there are other legal grounds for such a storage period.
4. For What Purposes Do We Process Your Personal Data?
4.1. The Company processes the above-mentioned personal data for the following data processing purposes: processing and administering service purchases (orders), identifying Company customers in the Company's information systems, registering on the Website and logging into your account, handling accounting documents related to service orders, contacting you regarding contractual obligations, and for direct marketing purposes (with prior consent from data subjects).
5. How Do We Process Your Personal Data?
5.1. We ensure that your personal data will be: processed lawfully, fairly, and transparently, collected for specified, explicit, and legitimate purposes and not further processed in a manner that is incompatible with those purposes, adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed (data minimization principle), accurate and, where necessary, kept up to date (accuracy principle), processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures (integrity and confidentiality principles).
6. What Are Your Rights as Data Subjects?
6.1. You have the following data subject rights, which we will implement upon receiving your request (by email at psichologijosmokymu@gmail.com or by letter to the Company's registered address PMC Baltic FZ-LLC, Compass Building SFFO0507, Al Shohada Road, AL Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates) and properly confirming your identity: to access your personal data and how it is processed, to request the rectification of inaccurate personal data related to you, to request that incomplete personal data be completed, to request that the Company delete personal data related to you if: a. they are no longer necessary to achieve the purposes for which they were collected or otherwise processed, b. you withdraw your consent and there is no other legal basis for processing your personal data, c. personal data was processed unlawfully, d. on other grounds specified in the Regulation; to request that the Company restrict the processing of your personal data, to receive personal data related to you that you have provided to the Company in a structured, commonly used, and machine-readable format, to object to the processing of personal data related to you (e.g., for direct marketing or otherwise).
6.2. You are informed that if you believe that your rights as data subjects have been violated, you can submit a complaint to the State Data Protection Inspectorate.
7. How Do We Process Personal Data for Direct Marketing Purposes?
7.1. Only with your prior consent and in accordance with the LEC, LLPPD, and Regulation provisions, we will send you the Company's newsletters via email and/or inquire about the quality of existing services.
7.2. We process the following personal data for direct marketing purposes: name, surname, phone number, email address.
7.3. Your personal data for direct marketing purposes are stored until you withdraw your consent to receive direct marketing communications.
8. To Whom Do We Provide Your Personal Data?
8.1. The Company's employees are granted access to your personal data only when necessary to perform their duties and only if the employee is committed to confidentiality.
8.2. The Company may provide your personal data to: data processors who provide services to the Company and process your personal data on behalf of and for the benefit of the Company or you, law enforcement authorities when there is a legal basis for it, other third parties with your consent.
8.3. We use only those data processors who ensure that appropriate technical and organizational measures are implemented in such a manner that processing will meet the requirements of the Regulation and ensure the protection of your rights as data subjects.
8.4. The aforementioned data processors are authorized to process your personal data only according to our instructions.
8.5. The data processor may not engage another data processor without the prior specific or general written authorization of the Company (data controller).
8.6. Your personal data may also be provided in response to official requests from state authorities and courts
